Under the Token and TT Service Provider Act (commonly called the TVTG, the Liechtenstein Blockchain Act), tokens are legally recognised as containers of rights that may be enforced like any other property right under Liechtenstein civil law. That statutory foundation means a business facing a smart-contract dispute in Liechtenstein – whether as claimant or respondent – can invoke property remedies, contract law and civil procedure rather than arguing from first principles that digital assets are property at all. What makes Liechtenstein's legal regime distinctive for smart-contract disputes?
Liechtenstein stands apart because the TVTG resolves a question that most jurisdictions still leave open: it defines the token as a legal object and the TT system (trustworthy technology system, meaning a blockchain or comparable distributed ledger) as a legally recognised environment in which rights are created, transferred and extinguished. That is not a small distinction. In most common-law and civil-law jurisdictions, practitioners must first persuade a court or regulator that a token carries legally recognisable rights before they can move to the substance of the dispute. The TVTG removes that preliminary hurdle.
The practical consequence is that Liechtenstein courts can engage with a smart-contract dispute on its merits. The subject matter – whether it is a governance token, a utility token representing a service entitlement, or a token backed by a real-world asset – carries statutory recognition as a rights container. The Financial Market Authority Liechtenstein (FMA) supervises TT service providers under the TVTG, creating a regulated environment that commercial counterparties and courts can reference. For a business drafting an enforcement strategy, that clarity is foundational.
Liechtenstein also sits within the European Economic Area (EEA). Under the Markets in Crypto-Assets Regulation (MiCA), EEA-passported entities carry their authorisation across member states, which means a Liechtenstein-authorised CASP (crypto-asset service provider) can operate across the EU/EEA. That passporting reach matters when a dispute involves counterparties or assets in multiple member states, because it determines which court has jurisdiction and which regime governs the underlying obligation.
Step 1: Characterise the dispute before choosing a forum
The first analytical step in any smart-contract dispute is to characterise what went wrong, because the characterisation determines the cause of action and the relief available. Not every on-chain loss is the same type of legal event.
There are broadly four categories. First, a code-execution failure: the smart contract executed exactly as written, but the written logic did not reflect the commercial intent of the parties. This is a contract-interpretation dispute; Liechtenstein civil law applies its standard rules of intent and good faith. Second, an exploit or manipulation: a third party used a vulnerability in the contract or the underlying protocol to extract funds. This gives rise to potential tort claims and, where the exploiter can be identified, proprietary claims over the extracted assets. Third, a governance dispute: token-holders voted to change protocol parameters in a way that one party argues was improper. Fourth, a cross-chain or bridge failure: assets were locked on one chain and the corresponding representation on another chain was not issued or was stolen in transit.
Each category carries a different evidentiary burden and a different urgency profile. An exploit that moves funds off-chain has a ticking clock. A governance dispute over protocol parameters may allow time for a careful arbitration strategy. Identifying the category early shapes the entire legal response – from interim relief to forum selection to the evidence-gathering tools deployed. Step 2: Secure the on-chain trail before it goes cold
On-chain tracing is a prerequisite, not an optional enhancement. Every enforcement strategy in a smart-contract dispute begins with a forensic map of the relevant transaction flow: the originating wallet, the contract interaction, the receiving address and any subsequent movements across bridges, mixers or centralised exchange deposit addresses.
A professional blockchain forensics report serves multiple purposes in a Liechtenstein-connected dispute. It supports an application for interim relief by demonstrating to a court that identifiable assets exist and can be located. It supports a disclosure application against an exchange or custodian, where the court must be satisfied that the respondent holds or has held the assets in question. And it provides the evidentiary spine of the merits case.
For stablecoin balances, the legal picture has a further dimension. Tether (USDT) and Circle (USDC) hold contract-level freeze authority over their issued tokens; those issuers generally act on law-enforcement request, a court order or an OFAC designation. Where misappropriated funds consist of or have been converted into major stablecoins, early coordination with the issuer – supported by a forensic report and a case reference – can freeze the balance at the contract level, independent of any judicial process. That capability is time-sensitive: issuers act fastest when the forensic trail is fresh and the relevant addresses are cleanly documented.
In a recent matter, a technology company identified that a counterparty had exploited a re-entrancy vulnerability in a shared liquidity contract and withdrawn a seven-figure balance in stablecoins. We coordinated a forensic tracing exercise and a parallel approach to the issuer within the first 24 hours; the balance was flagged before a secondary transfer cleared. The matter subsequently moved to Liechtenstein civil proceedings on the contract-interpretation question, with the forensic record as the primary exhibit.
Step 3: What interim relief is available, and from which court?
Interim relief – most commonly a freezing order preventing the dissipation of assets pending a final determination – is available in Liechtenstein through the civil courts, and the TVTG's property recognition of tokens means that a freezing application can be framed directly in terms of proprietary relief over identified token balances.
The cross-border reality, however, is that the most developed toolkits for digital-asset freezing relief currently sit in common-law forums. England and Wales, in particular, has developed a substantial body of practice around worldwide freezing orders, Norwich Pharmacal disclosure orders (compelling a third party – typically an exchange – to identify a wrongdoer) and Bankers Trust orders (requiring a financial intermediary to disclose transaction records). The CFAAR (Crypto Fraud and Asset Recovery network), launched in London in September 2021, represents a practitioner community that specifically addresses the procedural and evidentiary requirements for those applications.
For a Liechtenstein-seated dispute with assets that have moved to exchanges in other jurisdictions, a parallel-track strategy is often appropriate: Liechtenstein proceedings on the merits and substantive property rights, combined with targeted applications in the jurisdictions where the assets currently sit or where the exchanges are domiciled. DIFC Courts in Dubai, Singapore and Hong Kong have each developed meaningful practice in proprietary injunctions over crypto assets, and each of those forums can issue relief that reaches assets held on exchanges operating in or subject to the jurisdiction of those courts.
Selecting the primary forum requires a rapid assessment of three factors: where the defendant can be served, where the assets are held and which court's orders will be recognized and enforceable at the relevant exchange. That analysis is jurisdiction-specific and time-pressured. We work through it as part of the initial response strategy, in coordination with allied counsel in the relevant forum where required.
Step 4: How do Liechtenstein civil proceedings handle smart-contract claims?
Once interim relief has been secured and the forensic record is established, the merits of a smart-contract dispute proceed under Liechtenstein civil law. The TVTG provides the statutory baseline – tokens are property, TT system entries create and transfer rights – but the substantive dispute is resolved by applying general civil law principles to the on-chain facts.
For contract-interpretation disputes, Liechtenstein law follows civil-law doctrine on the interpretation of agreements: the parties' actual intent governs, with the written terms as evidence of that intent. Where the smart-contract code was intended to implement a specific commercial agreement, the documentation surrounding the deployment – term sheets, governance proposals, technical specifications – becomes central to the merits analysis. We advise clients to preserve all off-chain communications and governance records from the moment a dispute is anticipated; spoliation risk is as real in a blockchain dispute as in conventional commercial litigation.
For tort-based claims arising from an exploit, the claimant must establish that the loss flowed from conduct that is legally wrongful under Liechtenstein law. Where the exploiter is identified, this follows a relatively standard path. Where the exploiter is unknown – a common scenario in automated MEV (maximal extractable value) attacks or flash-loan exploits – the proceedings may need to be commenced against persons unknown, a procedural mechanism that several leading jurisdictions have developed specifically for crypto-asset recovery.
Liechtenstein's TVTG also governs TT service providers – custodians, exchanges and transfer agents operating on the blockchain. Where a TT service provider is implicated in a dispute (for example, where a custodian failed to implement appropriate security controls), FMA supervision and the TVTG's service-provider obligations provide an additional basis for a regulatory complaint or a damages claim running alongside the civil proceedings.
Step 5: How does the cross-border reality affect the strategy?
Very few smart-contract disputes are confined to a single jurisdiction. The protocol may be deployed on a global blockchain; the parties may be entities in different countries; the exchange where stolen assets arrived may be subject to the laws of a third jurisdiction entirely; and the banking interaction – where fiat conversion has occurred – may involve a bank in yet another country.
For a Liechtenstein-connected business, the EEA dimension means that civil judgments from Liechtenstein courts carry recognition across EEA member states under the applicable private international law rules. That is meaningful when the defendant has assets or operations in EU member states. It is less direct when the defendant's assets are in the UAE, Singapore or the United States, where recognition of foreign judgments follows bilateral treaty or common-law comity principles.
The tax angle requires separate attention. When a business recovers misappropriated digital assets, the timing and form of recovery can have tax consequences – whether the recovered amount represents a reversal of a prior loss, a gain or an indemnity payment may depend on the jurisdiction of the recovering entity and the applicable accounting treatment. Liechtenstein has its own tax regime for digital-asset businesses; operators with group structures spanning multiple jurisdictions should take advice on the tax treatment of recovery proceeds before those proceeds are realised or distributed.
Banking interaction is another practical constraint. A Liechtenstein-domiciled entity or trust that receives a significant on-chain recovery may need to demonstrate to its bank the legal basis and forensic provenance of the recovered funds before those funds can be moved to fiat. Courts and forensic reports provide that documentation, but the practical bank-onboarding step should be anticipated in the recovery plan, not treated as an afterthought.

Decision matrix: which profile should choose which path?
Not every smart-contract dispute justifies the same response. The appropriate strategy depends on the profile of the claimant and the nature of the loss.
Profile A – identified counterparty, Liechtenstein-connected contract, assets still on-chain or at a known exchange. This is the clearest recovery path. A Liechtenstein freezing application, supported by a forensic report, is the first step. Parallel disclosure proceedings at the exchange's home jurisdiction can follow within days. The merits of the contract dispute proceed on a normal civil timetable. Key risk: the defendant may move assets before the freezing order is served; speed of initial filing is critical.
Profile B – unknown exploiter, funds moved through mixers or multiple chains. The forensic burden is higher and the timeline to identity is less certain. Proceedings against persons unknown – available in England and Wales and in several other common-law forums – combined with a Norwich Pharmacal application against any exchange that processed the funds, is the standard approach. Liechtenstein proceedings provide the property-law foundation; the enforcement action happens in the forum with the most developed unknown-defendant practice. Key risk: mixer-obfuscation may break the forensic chain; early forensic investment is disproportionately important here.
Profile C – governance dispute, no asset misappropriation, dispute over protocol parameters or token distribution. This is a contract-interpretation matter. Urgency is lower. Liechtenstein arbitration or civil proceedings are appropriate. Consider whether the governance documentation constitutes a binding agreement under Liechtenstein law before filing. Key risk: the governance records may be ambiguous; preserving the on-chain voting record and any off-chain side agreements is the first priority.
Profile D – cross-chain bridge failure, counterparty in a different jurisdiction. The forum question is driven by where the bridge operator is incorporated or where it can be served. The TVTG supports the property characterisation of the locked tokens. The cross-border enforcement strategy requires allied counsel in the relevant jurisdiction. Timeline and capital exposure determine whether summary enforcement (attachment of fiat proceeds or exchange balances) or full merits proceedings is the right first move.
Addressing a common assumption: once the funds have moved, nothing can be done
A common assumption among business operators who have suffered a smart-contract exploit is that once funds leave the originating wallet, the legal system cannot reach them. That assumption is incorrect, and acting on it is one of the most damaging mistakes a business can make in the critical first hours after an incident.
On-chain funds are not anonymous. Every transaction is recorded on a public ledger, and blockchain forensics tools can trace asset flows across chains, bridges and exchange deposit addresses with a high degree of accuracy. Centralised exchanges are regulated entities in most major jurisdictions; they are subject to court orders and, in many cases, have cooperative relationships with law enforcement and specialist legal practitioners. Stablecoin issuers hold freeze authority at the contract level. The constraint is time, not legal capability. The longer a business waits – whether because of internal uncertainty, reluctance to disclose a loss, or a mistaken belief that recovery is impossible – the more likely the assets are to be converted, withdrawn, or moved beyond the practical reach of a freezing application. Acting within hours of an incident is not an overreaction. It is the standard of care in a digital-asset recovery matter.
